Why Choose Us

Mediation works best when it’s led by someone who genuinely understands family law — not just the process, but the substance behind it.

As a divorce mediator, Kristin Scully, Esq. draws on more than 12 years of experience litigating and negotiating divorce, custody, support, paternity, prenuptial and postnuptial agreements, military divorce, and post-judgment matters. She also serves as a court-appointed Guardian ad Litem, giving her a deep, firsthand understanding of what’s truly at stake for children and families navigating these disputes. That perspective shapes every mediation session she leads — grounded, empathetic, and focused on real, workable outcomes.

  • A calm, neutral, and compassionate approach to high-emotion situations
  • Deep knowledge of complex issues, including military pension division
  • A results-oriented process built to save you time, money, and stress
  • Flexible scheduling with half-day and full-day sessions

What Is Divorce & Family Law Mediation?

Mediation is a voluntary, confidential process in which a neutral third party — the mediator — helps both sides in a divorce or family law dispute communicate, negotiate, and work toward a mutually acceptable agreement. Unlike litigation, mediation is not about winning or losing. It’s about finding common ground on the issues that matter most, including:

  • Divorce and marital settlement agreements
  • Child custody and parenting plans (timesharing)
  • Child support
  • Alimony
  • Relocation disputes
  • Paternity matters
  • Prenuptial and postnuptial agreement disputes
  • Post-judgment enforcement and modification
  • Military divorce, including pension division

In many Florida family law cases, mediation is required by the court before a case can proceed to trial. Even when it’s not required, choosing mediation early can help families avoid the expense, delay, and emotional toll of prolonged litigation.

Frequently Asked Questions About Divorce & Family Law Mediation

What is a divorce mediator?

A divorce mediator is a neutral, trained professional who helps both parties in a divorce or family law dispute communicate and negotiate toward a mutually agreeable resolution. A mediator does not represent either party, take sides, or make decisions for the parties — instead, they facilitate discussion and help identify solutions both sides can accept.

Is mediation required in Florida divorce cases?

In many Florida circuits, courts require parties to attempt mediation before a family law case can proceed to trial. Even in cases where it isn’t mandatory, mediation is often recommended as a faster and less costly alternative to litigation.

How is mediation different from going to court?

In litigation, a judge makes the final decisions about your case. In mediation, you and the other party retain control over the outcome — the mediator simply helps facilitate productive conversation and negotiation. Mediation is also private and confidential, whereas court proceedings are part of the public record.

Do I need an attorney to participate in mediation?

You are not required to have an attorney present at mediation, though many parties choose to bring one for guidance and support. Your mediator, including Kristin Scully, acts as a neutral facilitator and cannot provide legal advice to either party during the session.

What issues can be resolved through mediation?

Mediation can address nearly any issue in a divorce or family law case, including division of assets and debts, alimony, child custody and timesharing, child support, relocation, paternity, and post-judgment modifications or enforcement.

How long does a mediation session take?

We offer half-day sessions (morning: 9:00 AM–1:00 PM EST, or afternoon: 1:30 PM–5:30 PM EST) and full-day sessions (9:00 AM–5:30 PM EST), depending on the complexity of your case and the number of issues to be resolved.

What happens if we reach an agreement during mediation?

If the parties reach a full or partial agreement, the mediator will help draft a written agreement outlining the terms. This agreement can then be submitted to the court for approval and incorporation into a final judgment.

What if we don’t reach an agreement?

If the parties are unable to reach a full agreement, the case may proceed to litigation on any unresolved issues. Even a partial agreement in mediation can narrow the issues that need to be decided by a judge, saving time and expense.

Is everything discussed in mediation confidential?

Yes. Under Florida law, communications made during mediation are generally confidential and cannot be used as evidence in court, which allows both parties to speak openly while working toward a resolution.

How do I schedule a mediation session?

You can schedule a half-day or full-day mediation session directly through our online scheduling link. Please note that your session is not confirmed until you receive confirmation from our office.
